Family-Based Immigration

Your Path to Working Legally in the U.S.

Employment-Based Visas

At Right Way Immigration Law Firm, we help people and companies apply for visas for temporary and permanent work in the United States. Our skilled staff provides specialized solutions to assist you in getting the necessary visa to work lawfully in the United States, whether your demands are short-term or long-term.

Employment-based immigration differs from family-based immigration in that it enables foreign nationals to live and work in the United States exclusively on the basis of their professional skills. The Immigration and Nationality Act (INA) divides applicants into categories depending on their occupation, education level, and particular requirements connected to their abilities and expertise.

Several types of employment-based visa categories fall under employment-based immigration, including:

  1. H-1B Visa: For specialty occupations requiring a higher education degree or its equivalent.
  2. L-1 Visa: For intra-company transferees who work for a multinational company, allowing them to relocate to a U.S. office.
  3. O-1 Visa: For individuals with extraordinary ability or achievement in their field, including arts, sciences, business, or athletics.
  4. E-2 Visa: For investors or employees of investment companies from treaty countries who wish to engage in business in the U.S.
  5. EB-1 Visa: For priority workers, including individuals with extraordinary abilities, outstanding professors or researchers, and certain multinational managers or executives.
  6. EB-2 Visa: For professionals with advanced degrees or exceptional ability in their field.
  7. EB-3 Visa: For skilled workers, professionals, and other workers, such as those in unskilled positions.
  8. EB-4 Visa: For special immigrants, including religious workers, certain employees of U.S. government agencies abroad, and others.
  9. EB-5 Visa: For investors who invest a minimum amount in a new commercial enterprise that creates jobs for U.S. workers.

The employment-based visa application process consists of many steps, including sponsorship from a US employer, labor certification, submitting a petition with US Citizenship and Immigration Services (USCIS), document submission, and interviews and assessments. Sponsorship is required to demonstrate unique abilities and a shortage of suitable US workers for the employment. Labor certification is necessary for certain visa types. Applicants must also provide proof of qualifications, job offers, and supporting documentation. Medical exams and background checks may be required, depending on the type of visa.

Right Way Immigration Law Firm provides specialized advice and assistance to individuals and employers seeking employment-based immigration.

We understand the nuances of the process and are dedicated to assisting clients in navigating their alternatives. We can assist you in achieving your immigration objectives and opening doors to new opportunities, whether you are a company seeking foreign talent or a professional hoping to advance your career in the US.
