Honor Crime in The Arab World

A persistent threat and U.S. asylum protections. Dec 30, 2024 | By Shrieen Deeb

Honor crimes persist as a pressing issue in parts of the Arab world, disproportionately affecting women and girls. These acts of violence, deeply rooted in patriarchal norms, are often carried out by family members to to'restore' honor when women are perceived to have violated social or religious expectations. The ongoing prevalence of such violence underscores the urgent need for protection for those at risk.

What Are Honor Crimes?

Honor crimes involve acts of violence, including murder, committed against women accused of bringing shame to their families. These crimes are often triggered by the following:

  • Refusing arranged marriages.
  • Having relationships outside of marriage.
  • Losing virginity before marriage.
  • Failing to adhere to modesty codes, such as wearing a hijab.

In many Arab societies, legal and cultural norms exacerbate these crimes. For instance, some countries have laws that reduce sentences for perpetrators who claim their actions were motivated by a need to restore family honor. Additionally, cultural norms often dictate that these crimes are viewed as private family matters, which fosters a culture of silence and impunity.

Prevalence of Honor Crimes

Although honor crimes are underreported, advocacy groups have highlighted their widespread nature:

  • Syria: Legal loopholes allow leniency for honor-based violence.
  • Jordan and Iraq: Numerous cases of honor killings reveal gaps in legal enforcement.
  • Palestine: Social stigma discourages victims from seeking help, perpetuating the cycle of violence.

These crimes are often viewed as private family matters, which fosters a culture of silence and impunity.

How U.S. Asylum Law Protects Victims

U.S. asylum law offers hope to individuals fleeing honor crimes. To qualify for asylum, applicants must demonstrate a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group (PSG). Victims of honor crimes often qualify under the PSG category.

Key Protections

  • Gender-Specific PSG Recognition: U.S. courts recognize gender-specific PSGs, such as women targeted for defying societal norms.
  • Country Conditions Evidence: Applicants can strengthen their cases by reporting systemic discrimination and honor crimes in their home countries. The U.S. Department of State often highlights such issues.
  • Legal Precedents: Courts have ruled in favor of women fleeing honor-based violence, recognizing the severe harm and systemic failures in their home countries.

Challenges for Asylum Seekers

Despite the legal protections, victims face significant hurdles:

  • Stigma: Discussing sensitive issues like relationships or virginity can be daunting.
  • Burden of Proof: Providing credible evidence is challenging in cases with undocumented incidents.
  • Legal Complexities: Cases require careful arguments to connect personal experiences with broader legal frameworks.

Conclusion

As honor crimes continue to reflect deep-rooted patriarchal norms in the Arab world, leaving women vulnerable to violence and systemic discrimination, we must recognize our role in combating this issue. U.S. asylum law provides a critical lifeline for victims, recognizing the severity of their harm and the lack of protection in their home countries. However, global efforts must persist in challenging societal and legal structures that enable such crimes, and we can all contribute to this cause.

If you or someone you know is seeking asylum due to honor-based violence, your support and understanding can make a significant difference.
